Karsten S.A. ("Karsten"), a publicly traded corporation registered with CNPJ No. 82.640.558/0001-04, is committed to protecting and respecting your privacy and personal data, and, in accordance with the General Data Protection Law (Federal Law No. 13,709/2018), Karsten will be the Controller of your Personal Data. Accordingly, this Privacy Policy is intended to clarify how we use, store and process your personal information ("Personal Data") obtained through the Karsten websites (www.karsten.com.br and www.karstensa.com.br) ("Site") and physical stores of Karsten products ("Physical Store").

 

The acceptance of our Policy will be made when you access, use, register on the Site or the Karsten Physical Store. Your access, use or registration will indicate that you are aware of and in full agreement with how we will use your information and personal data.

1 - WHAT IS PERSONAL DATA?

Personal data. Personal Data is all information that may identify or make a person identifiable ("Personal Data"), such as, for example, your name, IP address and home address.
Sensitive Data. Karsten does not collect or process Sensitive Personal Data of its customers that may lead to discrimination against its data subject, such as, but not limited to, data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, processing of genetic data, biometric data, data relating to a person's health or sexual life ("Sensitive Data").

 

2 - WHOM DOES THIS KARSTEN PRIVACY POLICY APPLY TO?

Karsten’s Privacy Policy applies to all of its personal customers, that is, all customers who make purchases via Karsten’s Website and Physical Stores and those who have in any way provided their Personal Data for processing by Karsten under this Policy.

4 - WHICH PERSONAL DATA DOES KARSTEN COLLECT?

During your experience on our Site or in any of our Physical Stores, Karsten collects your Personal Data in three ways: (i) information provided by you; (ii) information collected automatically when you enter the Karsten Site; and (iii) information from trusted sources.

Here, we highlight that you do not need to provide us with your Identity, Contact or Financial Data, but they are essential for the fulfillment of the purposes set out in this Policy. In addition, Karsten collects only data necessary for the execution of its business.
We may still use the information you provide to create Aggregated Data, such as statistical or demographic data. At this point, it should be noted that Karsten is committed to protecting and respecting your privacy, and although such Aggregated Data may originate from your Personal Data, it is not considered personal data according to the law, since it will be anonymized.

We use your Personal Data to comply with legal obligations when necessary.


6 - HOW CAN I ACCESS MY PERSONAL DATA?

You may access your Identity Data, Financial Data and Contact Data provided by you through our Site by accessing the "My Account" section. On the other hand, if your Personal Data has been provided in the Karsten Physical Store, to access it you will need to contact the store that owns your data or go there.

7 - HOW DOES KARSTEN SHARE MY PERSONAL DATA?

Karsten collects your Personal Data, but does not sell or market it. We only share your Personal Data in the following cases:

Third Parties and Service Providers

To serve our customers, we have some suppliers and partner companies. In this way, Karsten may share your Personal Data, for example: (i) with carrier companies, so that your products arrive at your home; (ii) with registration authenticating companies; (iii) with payment carriers; (iv) with advertising companies; (v) with marketing assistance providers; (vi) third-party platform available on the Site for querying order status; among others.

These third parties have access only to Personal Data essential to the performance of their functions and may not use your Personal Data for purposes other than described in this Privacy Policy. In addition, the third party service providers Karsten works with must process your Personal Data in accordance with this Privacy Policy and as permitted by the General Data Protection Act (Law No. 13,709/2018) 

Business Transfer

Karsten is always in development, and therefore can buy and sell other businesses. In these operations customer information is one of the transferred assets, but they remain subject to the purposes set forth in this Privacy Policy.

Talent Bank

To manage curricula, applications and interviews, Karsten shares your Data with supplier(s) who will assist in the organization of selection processes. 

Karsten's other activities

Karsten may share your Personal Data with other Karsten business centers that may act together in the execution of our activities and in the sale of products.

Legal Obligation

Under a legal obligation, Karsten may share your Personal Data.

 

 

8 - HOW DO COOKIES WORK? 

Karsten uses cookie technology to make your experience within the Site personalized, simple and meaningful. Cookies are small fragments of information emitted to your computer or similar device used to access the internet, which stores and sometimes tracks information about your use of the Site. In this way, cookies are responsible for recognizing your Access Data in order to identify more about your interests and offer you a personalized service according to your profile. Karsten may use your Identity Data, Contact Data, Browser Data and Usage Data to market products by sending marketing communications about our products and promotions. In this sense, you can request cancellation at any time.
If you are not interested in receiving our marketing communications, simply click on the unsubscribe link that is in the footer of all emails sent and/or inform through the contact method used.

10 - HOW DOES KARSTEN PROTECT YOUR PERSONAL DATA?

It is Karsten's responsibility to take care of your Personal Data and use it only for the purposes set out in this Privacy Policy. To this end, Karsten adopts appropriate security measures, such as the use of encryption techniques and other information security systems, to prevent your Personal Data from being misplaced, used, altered, disclosed or accessed in an unauthorized manner.
To make your purchase secure, the Karsten Site performs all data traffic using the Secure Socket Layer (SSL) certificate, which is a standard method used on the internet to protect communications between internet users and the Site by providing a 100% secure purchase.

Karsten strives to protect your information, but unfortunately the transmission of information over the internet is not entirely secure. In this way, it is important that you take good security practices regarding your password and devices (such as, but not limited to, computers and mobile phones). If you identify or become aware of any action that could compromise the security of your data, please contact us through the channels described in "What else do I need to know about this Privacy Policy?".

 

11 - WHAT ARE MY RIGHTS WITH RESPECT TO MY PERSONAL DATA COLLECTED?

In accordance with the General Data Protection Act (Law nr. 13,709/2018), you have the right to:

  • Confirm the existence of processing of your Personal Data;
  • Rectify and correct your Personal Data;
  • Delete your Personal Data;
  • Block the processing of your Personal Data;
  • Request the portability of your Personal Data;
  • Request anonymisation, blocking or deletion of unnecessary, excessive or processed personal data in non-compliance with legislation;
  • Withdraw consent;
  • Refuse the processing of information for marketing; and
  • Request information about the sharing of your Personal Data

 

You may exercise some of your rights by accessing "My Account" available on the Karsten Site. Also, to allow you to exercise your rights, there is the channel of our Data Processing Officer (dpo@karsten.com.br).

12 - HOW LONG DOES KARSTEN RETAIN YOUR PERSONAL DATA?

We retain your Personal Data only for as long as necessary to fulfill the purpose for which it was collected, including for the purposes of fulfilling any legal, contractual, accountability or request obligations of competent authorities. Such as: (1) even if you request deletion, we must keep your data for a minimum of 5 years, from the end of our relationship or your request for exclusion, which may occur first, based on Articles 12 and 34 of the Consumer Protection Code; (2) the data collected in an automated manner, for at least 06 months from the date of interaction in our environment, based on Article 15 of the Civil Framework of the Internet.

 

In some situations, Karsten may anonymize your data so that it is no longer associated with you for statistical and research purposes. In this case, we can use anonymized data without the need for notification.

13 - INTERNATIONAL TRANSFER OF YOUR PERSONAL DATA

Although Karsten's company is located in Brazil, and its products are purchased by people located in Brazil, and because of this, Brazilian laws related to the protection of Personal Data are applied, it is important that you know that we store your Personal Data in the cloud that has its servers located in other countries, international data transfer.

 

14 - WHAT ELSE DO I NEED TO KNOW ABOUT THIS PRIVACY POLICY?

Privacy Policy and Notifications Updates: In order to improve our policies and the protection of your Personal Data, this Privacy Policy may be updated at our sole discretion and at any time. In this way, we recommend that you periodically review our Site for knowledge of modifications that reflect the improvements made. Karsten is committed to protecting your privacy and Personal Data, so if needed your consent to promote any changes to this Privacy Policy, we will notify you so that you can or cannot agree to the change.

Partial Nullity: In the event that any provision of this Privacy Policy is declared void for any reason, such provision shall not affect the other provisions, which will remain in force and produce their effects. 

Tolerance: Karsten's omission or tolerance to require strict compliance with the conditions of this Privacy Policy does not, in any event, constitute a new or waiver, nor does Karsten exercise such rights at any time. 

Events beyond our control: Karsten is not responsible for any non-compliance or delay summability in the obligations assumed when caused by acts, events, failures, omissions or accidents that are beyond its reasonable control ("Force Major"), as legally provided. 

Legislation and Forum: This Policy is governed by Brazilian legislation. The Forum of the District of Blumenau, state of Santa Catarina is elected as the competent to resolve any issues arising from this Policy.
